
Terms and Conditions
This Short Term Rental Lease Agreement (this “Agreement”) is made by and between Owner and Guest as of the date of original reservation purchase. Owner and Guest may be referred to individually as “Party” and collectively as “Parties.” The Parties agree as follows:
1. Property. The property is a Short Term Rental. (the “Property”) which is privately owned and maintained. Please treat the property with the same care you would use with your own home and leave it in the same condition it was in when you arrived.
2. Guest. Guest is the individual listed on the invoice.
3. Rental. The Guest and Rental Party are transient guests, not tenants, and as such no anti-eviction laws apply to this rental or Guest/Rental Party.
4. Rental Party. Guest and any of their affiliates or associates who enter the house or surrounding area may be referred to as the “rental party”. All persons in the rental party will be bound by the terms of this Rental Agreement.
5. Conduct. Guest and Rental Party shall conduct themselves in a manner that will not disturb neighbors or the community. Repeat complaints from neighbors and/or police may result in Guests being asked to vacate the Property immediately and forfeit all reservation charges paid. Rental Party shall keep noise to a minimum between the hours of 10:00PM and 6:00AM.
6. Maximum Occupancy. Unless otherwise agreed upon in writing from Owner, the maximum number of persons allowed to stay overnight in the Property is limited to 12.
7. Overnight Guests. For the purposes of this Rental Agreement, overnight guests are identified as individuals staying in Property between the hours of 11:00PM and 7:00AM.
8. Rental Agreement Term: The term of this Rental Agreement will be from the Check-In to Check-Out dates reserved as per the invoice. In the event of a reservation modification agreed upon in writing by Owner via automated or manual confirmation, the Rental Agreement will be from the adjusted Check-in Date to Check-Out Date.
9. Check-In / Check-Out. The Rental Party may check-in and access the Property no earlier than the Check-In time shown when reserving Property. The Rental Party must depart the Property no later than the Check-Out time shown when reserving Property; Failure to depart Property by Check-Out time will result in a charge for an additional day. Failure to vacate Property on reserved Check-Out Date without prior written authorization to extend stay will result in a charge for an additional day, charged per day.
Requests for early check-in or late check-out are based on availability.
10. Rental Rules. Guest and Rental Party may be asked to vacate the Property immediately and forfeit all reservation charges paid if the Rental Rules are not followed;
Guest Age: Guest must be 21 years of age or older to reserve, is responsible for, and must accompany all individuals under the age of 21 throughout the stay.
Guest Identification: You may be asked to provide photo identification and a selfie, either in-person or via electronic delivery, upon check-in. Guests whose reservation is paid with a credit card in another individual's name may also be asked for additional documentation from the credit card holder.
Guest Responsibility: Primary Guest assumes responsibility for the conduct and safety of Rental Party as well as any damage to Property caused by a member of Rental Party.
Criminal Activity Prohibited: The use of property for any criminal activity is prohibited.
Firearms: Unless written approval from Owner is received in advance of stay, firearms are prohibited on Property.
Dangerous or Hazardous items: Dangerous or hazardous items which may cause harm to individuals, Property, or surrounding area are strictly prohibited. This includes but is not limited to the use of fireworks.
Smoking/Vaping: Smoking and/or vaping is not permitted on Property. Smoke damage, including odor, is not covered by standard cleaning and/or damage waiver and will be assessed a $250 fee.
Safety Devices: The Property may be equipped with external cameras for the safety of guests and the property. The safety devices do not view the interior of the home, unless the interior space is designated as private/off limits.
11. Pets. Pets, including emotional support animals, may be permitted and must be disclosed at the time of reservation; When permitted, a pet fee will be shown on the invoice when reserving Property; If no option to include pets is available when booking, then pets are not permitted; Service animals are permitted as required by law; Unless required by law, emotional support animals are considered pets for the purpose of Property’s pet policy; Undisclosed pets will not be permitted on Property grounds; Failure to observe the pet policy may result in a minimum $200 fine; Rental Party may also be asked to vacate the Property immediately and forfeit all reservation charges paid.
12. Payment. Guest agrees to pay the Reservation Total, including all fees and taxes, as described on the invoice when reserving Property; This Rental Agreement may be terminated by the Owner upon default of any payments or other obligations of the Guest, as outlined in this Rental Agreement.
Disputed charges may be recovered via local court and will carry a $150 processing fee plus court costs.
13. Cancellation. Property cancellation policy may vary based on travel dates and/or length of stay. The cancellation policy associated with your reservation will be displayed on the invoice when reserving Property; If Guest cancels the reservation before the penalty and/or non-refundable period, a full refund less credit-card processing fee will be issued. If Guest cancels the reservation within the penalty and/or non-refundable period, the appropriate fee up to 100% of reservation cost, will be assessed. When present, the cancellation penalty will not be waived due to inclement weather or other conflict, whether within or outside Guest control. No refunds will be given for late arrivals, early departures, or unused days.

15. Cleaning. A cleaning fee may be charged to the Guest. When charged, the cleaning fee will be displayed on the invoice when reserving Property. Daily, weekly, or other periodic “in-stay” housekeeping services are not included in the rental rate. On the day of check-in, Guest is responsible for inspecting the property and informing the Owner if it requires additional cleaning or is not in good condition. Additional cleaning due to Guest’s negligence or failure to adhere to Rental Agreement rules may result in additional charges.
16. Parking. Details on available parking are available in the Parking and Facilities section of our amenities. Cars parked illegally are subject to penalty and/or towing at the vehicle owner’s expense; Owner is not responsible for fees associated with parking, whether legally or illegally parked. Owner is not responsible for the safety or security of vehicles or their contents.
17. Owner Maintenance. Owner attempts to properly maintain the Property. While all amenities within the Property are in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, electronic equipment, internet access, cable service, or amenities or other appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Owner immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Owner or a person permitted by Owner access to the Property for purposes of repair and inspection. Owner is not responsible for any inconvenience that may occur and no refunds or reductions in reservation cost will be made due to failure of such items.

19. Indemnification. Guest acknowledges that the use of the Property by the Rental Party and Guest’s visitors is entirely at their own risk. Guest will indemnify and hold harmless Owner, their representatives, or software providers, from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, injury or death resulting from the use or occupancy of the Property or the failure of any member of Rental Party or Guest’s visitors to observe the Rules and restrictions set forth in this Rental Agreement.
20. Violation of Agreement. If Guest or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Owner may evict Guest and the Rental Party from the Property and Guest will forfeit all reservation costs and security deposit paid.
21. Governing Law. This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of New York (not including its conflicts of laws provisions). Any dispute arising from this Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.
22. No Waiver. Neither Owner nor Guest shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is made expressly and in writing.
